These Terms of Service ("Terms") govern your access to and use of The POD Lab (the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Definitions

  • "Service" means The POD Lab website, software, tools, APIs, and related services.
  • "You" / "User" means the individual or entity using the Service.
  • "Content" means text, images, prompts, inputs, files, and other materials you provide or generate.
  • "Outputs" means any results, recommendations, scores, or content generated by the Service, including AI outputs.

2. Eligibility and Account Responsibility

You must be at least 18 years old to use the Service. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.

3. The Service Is Informational — No Guarantees

The Service provides tools and AI-powered suggestions related to print-on-demand, ecommerce, ads, and marketing. Outputs may be inaccurate, incomplete, misleading, or not suitable for your situation.

WE DO NOT GUARANTEE any results, including sales, profits, ad performance, compliance, rankings, approvals, or outcomes of any kind. Your business decisions are your responsibility.

4. Not Professional Advice

The Service does not provide legal, financial, tax, accounting, marketing, advertising, or other professional advice. You should consult qualified professionals before acting on any Output.

5. Acceptable Use

You agree not to:

  • Use the Service for unlawful, harmful, fraudulent, or deceptive purposes
  • Upload or generate content that infringes intellectual property or violates rights of others
  • Attempt to reverse engineer, scrape, or bypass rate limits or security measures
  • Interfere with or disrupt the Service, servers, or networks
  • Use Outputs to violate third-party policies (e.g., Meta, Google, Etsy, Amazon) or applicable law

6. AI Outputs and IP / Ownership

  • You retain ownership of your Inputs.
  • Subject to these Terms, we grant you a non-exclusive, revocable license to use the Outputsfor your lawful business purposes.
  • No originality guarantee: Outputs may be similar to content generated for other users or available elsewhere.
  • You are solely responsible for ensuring that your use of Outputs does not infringe or violate third-party rights, platform rules, or laws.
  • The Service (including UI, code, methods, branding, and systems) is owned by The POD Lab and protected by intellectual property laws.

7. Billing, Trials, and Refunds

Subscription fees (and any trial terms) are presented at checkout or signup. You authorize us (and our payment processor) to charge your payment method for recurring subscription fees until you cancel.

Refunds: Unless explicitly stated otherwise in writing, fees are non-refundable. If you dispute a charge, contact us first before initiating a chargeback.

8. Suspension and Termination

We may suspend or terminate your access to the Service at any time, with or without notice, if we believe: (a) you violated these Terms, (b) you pose a risk to the Service, other users, or third parties, or (c) required by law.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE POD LAB SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES, EVEN IF ADVISED OF THE POSSIBILITY.

IN ALL CASES, OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO THE POD LAB IN THE 30 DAYS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless The POD Lab from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service, (b) your Content, (c) your violation of these Terms, laws, or third-party rights.

12. Changes to the Service or Terms

We may modify the Service or these Terms at any time. Continued use of the Service after changes become effective constitutes acceptance of the revised Terms.

13. Governing Law

These Terms are governed by the laws of the United States and the state/jurisdiction in which The POD Lab operates, without regard to conflict-of-law principles.
